These Terms of Service (the "Terms") govern all contractual relations between EDXAD LLC, a limited liability company organized under the laws of the State of Delaware (United States of America), registered under File Number 3503122, with its registered office at 8 The Green, Suite B, Dover, DE 19901, USA (hereinafter "BeVesper", "we", "us", the "Provider"), and any adult individual placing an order on bevesper.com (the "Client", "you").
BeVesper offers a visibility service intended for adults monetizing remote private conversations. The service consists in creating a personalized landing page hosted by BeVesper, driving a volume of targeted visitors to this page from third-party traffic networks, and enabling those visitors to contact the Client via the private communication channel declared by the Client (WhatsApp, Telegram, SMS).
Placing an order on bevesper.com implies full and unconditional acceptance of these Terms.
The service is strictly reserved for individuals who have reached the age of majority in their country of residence, and in all cases at least eighteen (18) years old.
By placing an order, the Client represents and warrants:

Any order failing to comply with these exclusions will be refused. The Provider reserves the right to assess at its sole discretion the compliance of an order, without being required to justify its refusal beyond referring to these Terms.
The Client completes the online order form, providing: contact email, display name, chosen photo, contact channel (WhatsApp, Telegram, or phone number), opening message, desired traffic type, plan, and campaign duration.
Each order is subject to a prior review by the Provider, covering in particular the compliance of the photo with the published rules, the nature of the promoted activity, and the consistency of the information provided. This review takes place within an indicative period of 24 business hours.
If the order is accepted, the Provider sends the Client a payment link via the third-party provider Wise Payments Ltd. The amount is denominated in euros (EUR), inclusive of all taxes for Clients established in the European Union. Payment is due upon ordering.
The personalized page goes live upon effective receipt of payment, generally within a few hours. Traffic to this page starts concurrently.
If the order is refused, no payment is requested and no traffic is delivered. The Provider has no obligation to provide detailed justification beyond a general reference to these Terms and the rules published on the site.
Prices are expressed in euros (EUR) and displayed on bevesper.com. Three plans are offered:
Each plan corresponds to an indicative volume of targeted visitors delivered to the Client's personalized page, within the French-speaking geographic zone (France, Belgium, Switzerland, Luxembourg, French Overseas Territories). The Provider does not guarantee an exact number of visitors.
The Provider reserves the right to modify its prices at any time. The prices applicable to an order are those displayed at the time of its submission.
Promotional codes are issued at the Provider's discretion, either nominally or as part of commercial operations. Each code may be subject to specific terms of use (duration, eligible plan, discount cap).
Only one promotional code can be used per order. Codes are not cumulative, not refundable, and not convertible into cash.
BeVesper is a visibility service through traffic delivery. The Provider delivers a volume of visitors to the Client's personalized page. The Provider does not guarantee:
Economic results depend entirely on the Client's presentation, offer, availability, and responsiveness. No claim regarding the number of contacts, conversations, or revenues can give rise to indemnity.
The Client represents that they hold all rights to the photo, username, contact number, and opening message provided in the order form. The Client indemnifies the Provider against any third-party claim relating to these elements.
The Client grants the Provider, for the duration of the campaign and strictly within its execution, a non-exclusive license to use, reproduce, technically adapt (resize, crop), and publicly display their photo and username on the personalized page put online by the Provider.
At the end of the campaign, the personalized page is taken offline within a period of seven (7) business days. The Client may at any time request the immediate removal of their page by writing to contact@bevesper.com.
All graphic, textual, and technical elements of bevesper.com (except content provided by Clients) are the exclusive property of the Provider.
One (1) modification per campaign is included in the price (change of photo, username, message, or contact information). Additional modifications are charged 20 EUR each.
Any modification request is sent by email to contact@bevesper.com and takes effect within an indicative period of 24 business hours after validation by the Provider.
In accordance with Article L. 221-28 of the French Consumer Code applicable to Clients residing in France, and with equivalent exceptions in the laws applicable to other Clients residing in the European Union, the Client expressly waives their right of withdrawal since service execution begins with their express consent, which occurs upon sending the payment link.
No refund can therefore be claimed under the right of withdrawal once the order is validated and payment is made.
Delivered services are non-refundable, except in the cases exhaustively listed below:
The refunded amount, if applicable, is capped at the amount actually paid for the order concerned.
The Provider may terminate any ongoing order at its sole discretion in case of serious breach of these Terms by the Client, notably in case of subsequent discovery of the use of the service for excluded activities (prostitution, escorting, content involving minors, illegal activities). Such termination occurs without indemnity and without refund of any remaining campaign balance.
The Provider is bound by an obligation of means and not of result.
The Provider cannot be held liable for:
In any event, the Provider's total cumulative liability under an order cannot exceed the amount actually paid by the Client for such order.
The processing of the Client's personal data is governed by the Privacy Policy, which forms an integral part of these Terms.
The Provider relies on third-party providers for the execution of the service, notably:
These Terms are governed by the laws of the State of Delaware (United States of America), except for the mandatory consumer protection rules applicable to the Client's country of residence.
Any dispute relating to their formation, execution, or interpretation falls within the exclusive jurisdiction of the competent courts of the State of Delaware, subject to any mandatory contrary provision of the law of the Client's country of residence.
Clients residing in the European Union retain the benefit of the mandatory consumer protection provisions of the law of their habitual state of residence.
The Provider reserves the right to modify these Terms at any time. The Terms applicable to an order are those published on the site at the time of its submission.
